By placing an order on this site, you agree to all of our policies which are listed below. Please click on a link for specific information on that particular policy.

Thank you for shopping at RadioDepot.com. Please read these terms carefully. You must accept these terms and conditions before your order will be processed. By placing an order from this site you acknowledge that you are ordering the correct products. If you have any doubts or questions, please give us a call at 1-888-RDEPOT1 (1-888-733-7681) prior to placing your order.

Cashiers Check (Certified from Major US Bank Only)
United States Postal Service Money Order (others not accepted)
Wire Transfer ($25 additional fee applies + your bank's fee to initiate the transfer (be sure and account for this or you will underpay))
Company Check or Personal Check drawn on US Banks Only*

*Must clear our bank before merchandise ships. (Typically 7-10 business days)

Returned Check Fee-$35. We do not accept Purchase Orders except from government agencies, schools and certain other public safety agencies and then only after verifying a favorable account credit history and verifying addresses for the organization. ALSO, a hard copy Purchase Order must be provided from the agency, signed by the person authorized to purchase and approve payments.

There are no NET terms offered with the exception of those accounts where purchase orders are accepted as outlined above. There is no minimum order amount.

Note concerning the State of CA and other states that may implement a fee for companies outside of their state doing business with agencies in their state - it is our position that this type of policy is ILLEGAL. Only the Federal Government can tax interstate commerce. We will not accept underpayments on any invoice to an agency in these states that is used to pay such fees or taxes. ALL invoices must be paid IN FULL. If any kind of excise tax is to be subtracted from a payment for an out of state vendor, the agency ordering product must add this amount ot the original invoice. There will be no exceptions to this policy. Failure to pay invoices in full will result in legal action up to and including collections and small claim proceedings in the state of TN including all costs of such actions.

Shipping Methods:

All items purchased via this web site are shipped via UPS or similar carrier with tracking capability. We ship UPS ground as our standard shipping method. For an additional cost you can elect to have packages shipped Next Day, 2nd Day, or 3 Day Select. We only ship to the United States. Note that the shipping method chosen does not guarantee that you will receive your order in that time frame. For example, if you order on a Wednesday and select 2nd Day Air as the shipment method and we do not have the item in stock, you will obviously not receive the item on Friday. We do guarantee that we will ship via your preferred method once we have the item in stock.

We DO NOT ship to any foreign country, (including Canada) so please do not ask. We DO NOT ship to US Territories including Puerto Rico, Guam, etc. As a rule, we DO NOT normally ship to freight forwarders due to the excessive fraud found in shipments to these addresses. We DO NOT ship to APO addresses since UPS does not support shipments to such addresses.

We only ship to the billing address of the credit card that is on file with the issuing credit card file. We do not ship to PO Boxes. If the credit card billing address on file is a PO Box, a physical address must be put on file with your credit card company.

Once your order is entered into our system, you will be sent an e-mail confirmation with your order number so it is important that you provide a correct email address.

Many times, packages sent from us will require a signature. The customer should plan for this and arrange for someone to be available to sign for the package(s).

It is the customer's responsibility to provide us with a valid shipping address that is recognized by UPS. UPS does not ship to PO Boxes so please be aware of this. If a customer provides an invalid address which is undeliverable according to UPS, or if the package requires a signature and no one is available to sign for the package, and the package is returned to us as undeliverable, the freight cost of the original shipment plus the return shipment cost back to us plus any reshipment cost will be the responsibility of the customer.

Submitting An Order:

Payment for merchandise must be received prior to 2PM (CST) to begin processing your order the same day. All orders must be placed on-line, faxed in, or mailed in.

Discontinued and Backordered Items:

Sometimes manufacturers may discontinue items or place them on extended backorder without our knowledge. Please understand that we have no control over these situations. We will attempt to help you find an alternate item for your application in the event that this situation does occur. However, please note that the replacement item may have a higher cost than the original item of interest.

Pricing Errors / Refusal To Fulfill Orders:

We reserve the right to refuse to accept an order for any reason. As with any enterprise, sometimes pricing errors do occur. At no time will a customer be charged more for an item ordered without first obtaining permission for the price increase in writing from the customer.

Equipment Software / Firmware Revisions:

Please note that radios are electronic equipment and, thus, contain software internally that may be updated from time to time by the manufacturer of the equipment. It is impossible to keep all inventory items up to date with the latest manufacturer's software releases. We make no promise or guarantee that the product you receive will have a certain version of the manufacturer's software or firmware. If you need a certain version of the software or firmware, we will do our best to help you obtain that version in your equipment. Please contact us with any questions that you may have about this subject.

Performance of Received Equipment Including Coverage:

We guarantee that the equipment that we sell is factory new (unless specifically noted) and that it will perform to factory specifications. However, we do not guarantee that the radio equipment that we sell will cover a certain area (commonly referred to as "Range"). Range is not specified by any manufacturer as there are too many variables involved (like terrain, building construction, etc). If there are any concerns about coverage, the customer needs to obtain demo equipment of a similar make and test the equipment BEFORE ordering. Used equipment cannot be returned. See the "All Sales Are Final" section below for additional information on our return policy. Our personnel will be happy to discuss different equipment options to meet your needs but please keep in mind that recommendations do not and can not guarantee coverage or range for your particular application.

As for warranties, all new equipment usually has a manufacturer's warranty period. Airwave will assist you with any warranty claim. However, the manufacturer of the equipment has the final say on if a warranty claim will be honored or not. Reasons for a warranty claim denial include (but are not limited to), improper use, physical abuse or liquid damage. Airwave is under no obligation to honor any warranty if it has been denied by the manufacturer.

Two-Stepping or Reselling of Radio Equipment:

YOU ARE NOT AUTHORIZED TO RESALE ANY MOTOROLA EQUIPMENT THAT YOU PURCHASE FROM THIS SITE.

Airwave Communications Corporation, a Motorola Authorized Two-Way Radio Dealer, whose on-line internet sales division is known as RadioDepot.com has an agreement with MOTOROLA INC. to only sell their two-way radio equipment directly to the end user.

Airwave Communications/RadioDepot.com is required by contract TO NOT KNOWINGLY SELL any Motorola two-way radios and communications equipment to others who we suspect of reselling the equipment.

The unique serial numbers of all Motorola radios sold via this web site are reported to Motorola monthly, including the end user information. If it is determined that the customer who purchased radios via this site did indeed violate this policy and resold this equipment as new, Motorola may charge Airwave Communication/RadioDepot.com with fines and penalties.

By accepting these terms you agree that you are not purchasing these radios for resale. If it is determined by Motorola that these radios were purchased for the sole purpose of being resold, Airwave Communications/RadioDepot.com will hold you, the purchaser of the equipment, liable for any and all penalties/fines imposed by Motorola. If Airwave Communications/RadioDepot.com is forced to use legal counsel to resolve any two-stepping issue, you the purchaser will be held legally responsible for any and all court costs and legal fees incurred in the defense of this issue.

Credit Card Fraud:

By using this site you are entering into a Legal and Enforceable Online Contract with us. We employ many different methods to help defend against credit card fraud.

If you attempt to perform credit card fraud via this site, you will be prosecuted to the full extent of the law.
You will be held responsible for all legal fees, including but not limited to, attorney fees, private investigator fees, filing fess with the appropriate government agencies, all travel expenses and anything else necessary for us to recover any losses, regardless of the amount.

We are a tenacious bunch and we will not rest until we have prosecuted you. If you are thinking of trying to rip us off, do yourself a favor and move on to easier game.

All Sales are Final:

All sales made via this site are final unless we made a mistake and sent you an item that you did not order. In that case, we will issue a charge on your credit card for the correct item and ship it to you at no additional charge for shipping and we will, at our discretion, provide you with a pre-paid shipping label and a valid Return Merchandise Authorization (RMA) number to send the incorrect item back to us. A valid RMA number must be clearly marked on the returned package or the package will be refused and will be returned to you at your expense.

Once we receive the incorrect item back from you (it must be in new, unused condition), we will issue you a credit for the returned incorrect item within 10 working days. Failure to return the incorrect item within 15 calendar days from invoice date or returned items that show signs of damage or use will result in this offer for return and credit being withdrawn, no credit will be given for the item, and the customer will be responsible for any return shipping to the customer. Furthermore, any subsequent return of the item will be refused.

If you incorrectly ordered an item, we may, at our discretion, elect to make an exception to this policy and allow you to return the item. However, up to a 25% restocking fee may apply. Please keep in mind that, if item was ordered via credit card, we still have incurred costs in processing the original charge, programming, shipping, etc. You must first obtain a RMA number before returning any merchandise. Without a valid Returned Merchandise Authorization (RMA) number clearly marked on the package, the package will be refused and sent back to you at your expense.

Any item being returned for credit must be returned within 15 days of the original purchase date and it must be in its original, unused condition along with all documentation, packaging, and original paperwork. Original shipping charges will not be refunded.

Any and all shipping charges to return any item to us will be the responsibility of the customer.
